California is considered a no-fault state, with “irreconcilable differences” as the usual grounds. There is no need to blame the divorce on one party’s misconduct, such abandonment or infidelity, though such behavior may be considered when the court decides on spousal support or property division.
Even with a no-fault divorce there are often contested issues, principally concerning money. California is a community property state, which generally means that all property and debts acquired during marriage are deemed jointly owned and are evenly divided upon divorce. Some assets, however, are considered each spouse’s separate property, such as inheritances, gifts and property that the spouse owned before the marriage and income earned from those assets during the marriage. There are always gray areas for property claimed by one spouse to be separate and by the other to be marital in nature. In addition, alimony claims are often contested, requiring extensive proofs and evaluation.
Some couples are eligible for a form of California uncontested divorce called summary disposition. This is available for marriages of less than five years’ duration, when there are no minor children, no alimony is sought and neither spouse owns real estate. The spouses sign a settlement agreement that divides all their assets and debts, which must have values below certain thresholds set by law.
